1. Acceptance of Terms
By purchasing and using the WordPress theme provided by Sightsee Design (“we”, “us”, “our”), you (“you”, “user”, “customer”) agree to be bound by the following terms and conditions (“Terms of Service”).
2. Theme License
Upon purchase, we grant you a non-transferable, non-exclusive license to use the WordPress theme on one (1) domain only. You may not use the theme on more than one domain. You may not resell, redistribute, or transfer the theme to others.
3. Limitation of Liability
You expressly understand and agree that we will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from your use of the theme.
We make no warranties regarding the functionality, performance, or suitability of the theme for your website. It is your responsibility to ensure that the theme meets your specific requirements.
4. Updates and Support
We reserve the right to update, modify, or discontinue the theme at any time, without notice. Any updates or modifications will be subject to these Terms of Service.
Support for the theme is provided on an “as is”, “as available” basis and while we strive to provide a good user experience, we make no guarantees regarding the timeliness or quality of our support.
5. Changes to the Terms of Service
We reserve the right to modify these Terms of Service at any time. It is your responsibility to review these Terms of Service periodically for changes. Your continued use of the theme following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
6. Governing Law
These Terms of Service and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the laws of the state of Oregon.
